ACCEPTABLE USE POLICY

Effective Date: September 6, 2026 Provider: BDLOGIC LLC d/b/a FogMonkey ("Company") Abuse contact: abuse@fogmonkey.com

This Acceptable Use Policy is a companion to, and incorporated by reference into, our Terms of Service, and uses the same defined terms (Company, Services, Upstream Registrar, Registry, Domain, Registrant, Privacy Service).

1. Scope

This Acceptable Use Policy ("AUP") governs your use of the Services and any Domain registered, renewed, transferred, or managed through us. It applies to you and to anyone using a Domain or your account, including your own customers or end users. Violation is a breach of the Terms of Service and may result in the actions described in Section 8.

2. Your Responsibility

You are responsible for all activity conducted through your account and your Domains, and for ensuring that any end user of a Domain you manage complies with this AUP, all applicable ICANN, Registry, and Upstream Registrar policies, and all applicable laws. You may not use the Services to assist any third party in violating this AUP.

3. Prohibited Activities — General

You may not use the Services or any Domain to:

  • Violate any applicable law or regulation, or facilitate illegal activity.
  • Infringe the intellectual-property or other rights of others, including trademark, copyright, or patent rights.
  • Register or use a Domain in bad faith to profit from another's trademark (cybersquatting), or in violation of the UDRP or URS.
  • Engage in fraud, deceptive practices, impersonation, or misrepresentation.
  • Publish, host, or distribute unlawful, defamatory, harassing, threatening, or violent content.
  • Create, store, or distribute child sexual abuse material (CSAM) or any content that exploits or endangers minors. Such material will be reported to the National Center for Missing & Exploited Children (NCMEC) and other appropriate authorities.
  • Distribute content or engage in conduct that violates ICANN, Registry, or Upstream Registrar policy.

4. DNS Abuse (Prohibited)

Consistent with ICANN's DNS Abuse mitigation requirements, you may not use, configure, or allow a Domain to be used for any of the following, whether by you or a third party:

  • Malware — distributing, hosting, or commanding malicious software.
  • Botnets — operating or participating in botnet command-and-control.
  • Phishing — deceptively soliciting sensitive personal, financial, or account information.
  • Pharming — redirecting users through DNS manipulation to fraudulent destinations.
  • Malicious spam — sending unsolicited bulk email where it is used as a delivery vector for malware, botnets, phishing, or pharming.

Where Company, the Upstream Registrar, a Registry, or ICANN has actionable evidence that a Domain is being used for any form of DNS Abuse, appropriate mitigation action reasonably necessary to stop or disrupt the abuse may be taken promptly and with or without prior notice to you (see Section 8).

5. Network, System, and Resource Abuse

You may not: attempt to gain unauthorized access to any system, network, or account; conduct port scanning, penetration testing, or intrusion without authorization; launch or facilitate denial-of-service attacks; interfere with service to any user or network; or place an unreasonable or disproportionately large load on the Services or the Upstream Registrar's systems, including through abusive automated queries or misuse of any API.

6. Email and Messaging Abuse

You may not send unsolicited commercial email in violation of applicable anti-spam laws (such as CAN-SPAM or equivalent), operate mail systems in a manner that harms others, or use a Domain to support any of the foregoing.

7. Registration Data Integrity

You may not provide false, inaccurate, or misleading Registrant data, conceal your identity for an unlawful purpose, or fail to keep Registrant data accurate and current as required by the Terms of Service and ICANN policy. Falsified registration data is an independent ground for suspension or cancellation.

8. Reporting Abuse; Enforcement and Remedies

Reporting. Report suspected abuse — including DNS Abuse (malware, botnets, phishing, pharming, and malicious spam) and illegal activity — to abuse@fogmonkey.com. Consistent with the abuse-handling standard in ICANN Registrar Accreditation Agreement §3.18, we will acknowledge receipt of your report and take reasonable and prompt steps to investigate and respond appropriately. Where we have actionable evidence that a Domain is being used for DNS Abuse, we will promptly take the mitigation action reasonably necessary to stop or disrupt it. As a reseller, Company provides first-line abuse handling for its customers and is not the ICANN-accredited registrar of record. Law-enforcement, consumer-protection, and other illegal-activity reports requiring the registrar's dedicated round-the-clock contact are forwarded to, and handled by, the Upstream Registrar as the sponsoring accredited registrar through its abuse channel at https://newfold.com/abuse (selecting the SRSplus brand); we also forward reports to the applicable Registry or to appropriate authorities where warranted. We document our receipt of and response to abuse reports and retain those records as required by applicable policy.

Enforcement. Upon a violation of this AUP, or where required or requested by the Upstream Registrar, a Registry, ICANN, law enforcement, or a court, or where there is actionable evidence of DNS Abuse, Company may, in its discretion and with or without prior notice: issue a warning; suspend, lock, disable DNS for, place on clientHold, or cancel a Domain or account; suspend, lift, or reveal the Privacy Service on a Domain, so that the underlying Registrant details are published or disclosed, where reasonably necessary for an abuse investigation or where required or requested by law, a court, law enforcement, ICANN, a Registry, or the Upstream Registrar; remove or disable access to content; and cooperate with and disclose information to law enforcement or other authorities. The Privacy Service is not a shield for the conduct prohibited by §7: it protects your details from routine public publication, not from lawful disclosure.

No refund; no liability. Action taken in good faith under this AUP does not entitle you to any refund, and Company has no liability for any such action, subject to and consistent with the Limitation of Liability in the Terms of Service. You will indemnify the Indemnified Parties for claims arising from your violation of this AUP as provided in the Terms of Service.

9. Flow-Down of Upstream and ICANN Policy

Your use of the Services and Domains is also governed by the acceptable-use, abuse, and dispute policies of the Upstream Registrar (SRSplus / Network Solutions / Web.com), the applicable Registries, and ICANN, as amended from time to time. Where those policies require action or prohibit conduct, they apply to you directly and control to the extent required, and Company may act as necessary to comply with them.

10. Changes

We may update this AUP from time to time by posting the revised version with a new Effective Date. Continued use after changes constitutes acceptance.
